Marshall Bennett of Marshall & Melhorn will present on the Proposed Local Patent Rules to be adopted by the Northern District of Ohio.  Mr. Bennett’s presentation will start after lunch at approximately 1p.m.  One hour of CLE credit will be sought from the Ohio Supreme Court. Payment for the CLE portion of the meeting is $20 and will be accepted in advance or at the door.

On October 27^th, TIPLA will be holding its annual industry tour.  This year we will be touring the BASF Automotive Coatings R&D facility located at 6125 Industrial Parkway, Whitehouse, OH 43571.

BASF is the world’s leading chemical company with a portfolio that ranges from chemicals, plastics, performance products, agricultural products and fine chemicals to crude oil and natural gas. BASF’s Whitehouse facility is its Coatings Technology Support Center. The facility is the R&D site for BASF’s Automotive Refinish Coatings Solutions business in North America. The site also houses color information laboratories, a state-of-the-art refinish Application and Training Center, and BASF’s North American Customer Service Center that supports BASF’s refinish and industrial coatings customers in North America.

The September luncheon meeting of the Toledo Intellectual Property Law Association will be held at the Toledo Club on Tuesday, September 8, 2008.

We are very pleased to announce that our featured speaker will be Mr. David Kramer, Vice President and Practice Leader for Oswald Companies’ Lawyers’ Professional Liability (LPL) practice. The LPL practice involves program placement, coverage analysis, risk management and claims consulting. Prior to joining Oswald Companies, Mr. Kramer worked for a national broker, specializing in lawyers’ professional liability insurance, and acting as general counsel. Prior to his work in the insurance industry, Mr. Kramer worked as an attorney.

Mr. Kramer will be speaking on Intellectual Property Insurance and Risk Management. The presentation is pending with the Ohio Supreme Court for 1.0 CLE hours. 

The regular luncheon will begin at 11:45 a.m. and end at approximately 12:45 p.m. The CLE program will commence immediately following the completion of the luncheon. Members are welcome to attend either or both portions of the regular meeting, as time permits. To receive CLE credit, members are required to be present for the full CLE program and to submit a registration form accompanied by the discounted fee.

Our lunch will be honey barbecued chicken w/ a side salad. Dessert will be peach cobbler.

Many thanks to each member who attended the 2nd Annual Quad City IP Dinner and Symposium on Thursday and Friday, July 16th-17th, at the University of Dayton.   We have received many positive comments about the program, which included a presentation by Mr. Nick Godici, recently appointed Special Advisor at the U.S. Patent and Trademark Office.  A copy of the presentation has been mailed to the membership.  The program also included some excellent panel discussions on the topics of post-grant oppositions (currently being considered in patent reform legislation) and inequitable conduct reform.

The Quad City program concludes the TIPLA programming for the 2008-9 season.  We are presently preparing the programming for the 2009-10 TIPLA season, and regular luncheon meetings with CLE will resume in September.  TIPLA elections will also be held at the luncheon meeting in September.  Kindly contact the TIPLA officers if you have any suggestions or requests for speakers and topics in 2009-10.

Bio: Edward J. Damich was appointed a judge of the United States Court of Federal Claims on October 22, 1998, by President Bill Clinton. He served as Chief Judge from 2002 – 2009. Judges of the Court serve for a term of 15 years. The United States Court of Federal Claims, based in Washington, D.C., hears cases for monetary damages against the federal government, except cases for physical injury. Its docket includes cases involving government contracts, tax refunds, civil service and military pay, land use, Indian lands, and patent and copyright. A resident of Washington, D.C., Judge Damich was born in Pittsburgh, Pennsylvania, and raised in Miami, Florida.

Judge Damich has an A.B. degree from St. Stephen’s College, Dover, Massachusetts; a J.D. degree from Catholic University; and L.L.M. and J.S.D. degrees from Columbia University. From 1995-98 Judge Damich served as Chief Intellectual Property Counsel for the Senate Judiciary Committee. During his tenure on the Committee, he assisted the Chairman, Senator Orrin Hatch, with the passage of the Digital Millennium Copyright Act (DMCA), the most significant change in copyright law since the Copyright Act of 1976. The DMCA updated U.S. law for the digital age and for the Internet. In addition, he worked on the Omnibus Patent Act, the basis for the 1999 American Inventors Protection Act. He was also a member of the U.S. delegation at the World Intellectual Property Organization (WIPO) diplomatic conference, which concluded the WIPO Copyright Treaty and the WIPO Performances and Phonograms Treaty.
In September 1992, Judge Damich was appointed by President George H. W. Bush to be a Commissioner of the Copyright Royalty Tribunal (CRT). In formal adjudicatory proceedings, the CRT set rates and distributed royalties under the statutory license provisions of the Copyright Act regarding cable television, non-commercial broadcasting, satellite television, sound recordings, and digital audio recording technology. He served as a Commissioner until November 1993.

At present Judge Damich is a Distinguished Visiting Professor of Intellectual Property at the Columbus School of Law of Catholic University. He has been an adjunct professor of law at the Georgetown University Law Center and a professor of law at George Mason University and at Delaware Law School of Widener University.

The Toledo Intellectual Property Law Association (TIPLA) is pleased to sponsor a program titled “Role of the U.S. Patent Examiner; Patent Examiner Training Academy” on Friday, May 15, 2009. The program will be held at the University of Toledo, College of Law. The program will include a presentation by Ms. Deborah J. Reynolds, Patent Training Program Administrator at the United States Patent and Trademark Office in Alexandria, Virginia. Topics such as an overview of the role played by the U.S. Patent Examiner, how to become a U.S. Patent Examiner, and rules and regulations taught at the Patent Examiner Training Academy will be discussed. Specific modules used to train new Patent Examiners will be reviewed during the presentation.

Continuing legal education (CLE) of 3.0 credit hours has been applied for with the Supreme Court of Ohio. Attorney admission is $40.00 for TIPLA members, and $60.00 for non-members. Admission to the program is free for law and science/engineering students and professionals interested in a career with the U.S. Patent and Trademark Office.

BIOGRAPHY – Ms. Deborah J. Reynolds, Patent Training Program Administrator

Ms. Reynolds holds the position Patent Training Program Administrator in the Office of Patent Training at the United States Patent and Trademark Office. She oversees operations of the Patent Training Academy, which includes the new patent examiner training program; and has graduated over 2400 new patent examiners over the past 3 years. Previously Ms. Reynolds was a class manager in the Patent Training Academy where she oversaw 3 on-going classes, with over 300 employees under her responsibility. Prior to joining the Office of Patent Training, Ms. Reynolds was both a Quality Assurance Specialist and a Supervisory Patent Examiner for Technology Center 1600. Ms. Reynolds came to the USPTO in July 1996 and examined in the gene therapy and transgenic animal arts in Technology Center 1600. She progressed to Primary Examiner and was promoted to Supervisory Patent Examiner in November of 2000. Ms. Reynolds holds a Bachelor’s of Science in Chemistry from Pikeville College, in Kentucky. Before beginning her career at the USPTO, she worked in the Biochemistry Department at Uniformed Services University and the National Institute of Allergies and Infectious Diseases, National Institutes of Health.
